Read this before you sign in, before you buy $BANANA, and before you expect anything from Fapes. It is written in plain English because the things it says are worth understanding rather than skimming.

1. Who these terms are between

These terms are an agreement between you and the operator of Fapes at fapes.family (“we”, “us”). By signing in, using the site, or acquiring $BANANA, you accept them. If you do not accept them, do not use the site.

We can change these terms. When we do, the date above changes and the current version is always the one on this page. If you keep using the site after a change, you accept the new version. We will not email you about it.

2. What Fapes is

Fapes is a game and a collectible art project. You sign in with an X account, you get a profile, other people can give you upvotes, and at some point the top of that list may be offered a digital collectible. That is the entire product. It is entertainment.

It is not a financial service, a securities offering, a fund, a managed account, a savings product, a lottery, or a business you own part of. We do not hold money for you, we do not invest anything on your behalf, and we do not employ anyone to make a number go up.

3. Nothing here has financial value

$BANANA is a memecoin. A Fapes collectible is a picture. Neither one is backed by anything, redeemable for anything, or a claim on any asset, revenue or property of ours. We assign them no value and we do not undertake to maintain, support or create a market for either of them.

Any price either one trades at is set entirely by other people trading with each other, on venues we do not operate and do not control. That price can go to zero. It can stay at zero. Liquidity can disappear entirely, at which point holding something is the same as holding nothing, because nobody will buy it at any price.

You should expect to lose the entire amount you spend. That is the realistic outcome for the overwhelming majority of tokens like this one. Never spend money you need. Never spend money you would be upset to lose completely.

4. No promise of profit, and no promise of anything else

We make no representation, guarantee or promise — express or implied — that you will earn anything, receive anything, gain anything or benefit in any way from using this site, from placing upvotes, from climbing the list, from writing anything, or from holding $BANANA.

Nothing anywhere on this site is a forecast. Nothing is a target. There is no roadmap you can hold us to, no revenue share, no buyback, no floor price, no treasury commitment and no undertaking to do anything in future. Statements about what we intend are statements of present intention only, and intentions change.

Nothing on this site is financial advice, investment advice, legal advice, tax advice or a recommendation to acquire or dispose of anything. We are not your adviser, broker, fiduciary or agent, and no relationship of that kind arises from your use of the site. If you want advice, get it from someone qualified in your own jurisdiction who is not us.

5. How we make money, stated plainly

We earn a 0.05% creator fee on Pump.fun trading of $BANANA. That fee is paid to us on trades in both directions, whether the price is rising or falling, and it is our only revenue from this project.

We hold no $BANANA supply. There is no founder allocation, no investor tranche, no advisor allocation and nothing vesting. Those are two separate facts and we state both, because stating only the second would leave out the part that affects you.

Our interest is in trading volume. Yours may not be. Read everything we say with that in mind.

6. The list, the upvotes and the mint

One X account is one participant. Every participant gets 3 upvotes to give away, cannot vote for themselves and cannot vote for the same participant twice. An upvote can be taken back and moved.

We intend to offer a collectible to those at the top of the list — around the top 100 — at a moment we call the snapshot. We cannot promise that the snapshot will happen, that it will happen on any particular date, that the collectible will be created at all, or that the terms described anywhere on this site will be the terms that apply when it does. Supply, timing, eligibility and the rules of the list may all change, and the current version is whatever this site says at the time.

A position on the list is not property, is not transferable and gives you no enforceable right against us.

7. Who may use this

You must be at least 18 years old, or the age of majority where you live, whichever is higher, and you must have the legal capacity to enter into these terms.

You must not use this site if doing so is unlawful where you are. Laws about tokens, collectibles, promotions and games differ enormously between countries and change often. Determining whether your participation is lawful is your responsibility, not ours, and we do not advise on it.

You must not use this site if you are resident in, located in, or acting on behalf of anyone in a jurisdiction subject to comprehensive sanctions, or if you appear on any sanctions or restricted-party list. We may block access from any territory at any time, with or without notice.

8. Your account and what is public

Signing in reads your X handle, display name and profile picture. We never post as you and we do not read your messages. You may edit your display name, your biography and your avatar, and you may stop using the site at any time.

Your profile, your position on the list and anything you write through the site are public. Assume that anything you put here can be read, copied, quoted and screenshotted by anyone, permanently. Do not put anything here you would not want kept.

You keep ownership of what you write. By posting it you give us a non-exclusive, worldwide, royalty-free licence to host, display, reproduce and distribute it in connection with operating and promoting the site, and you confirm that what you post is yours to post.

9. Acceptable use

Do not run multiple accounts to farm upvotes. Do not buy or sell upvotes or positions. Do not use bots, scripts or automation against the site. Do not attempt to reach accounts, data or systems that are not yours. Do not probe, scan or interfere with the service or the infrastructure it runs on. Do not post anything unlawful, abusive, hateful, threatening or deceptive, or anything that infringes somebody else’s rights.

We may remove any profile, post or account, and may withhold any benefit, at our sole discretion, with or without notice or explanation. There is no appeal and no compensation.

10. Availability

The site is provided as it is and as it is available. We do not guarantee that it will be online, accurate, complete, uninterrupted, timely, secure or free of errors. Numbers shown here — balances, counts, ranks, timestamps — may be wrong, stale, cached or missing, and must not be relied on for any decision that matters to you.

We may change, suspend, restrict or discontinue any part of the site, or all of it, at any time and without notice. We are not obliged to keep it running, to preserve data, or to give any notice before stopping.

11. Things outside our control

Blockchains, wallets, exchanges, launchpads, bridges and token contracts are operated by third parties. So is X, and so are the services hosting this site. We do not control any of them and we are not responsible for what they do, what they charge, their outages, their decisions about your account, or losses arising from them.

Transactions on a public blockchain are irreversible. If you send something to the wrong address, lose a key, sign a malicious transaction or are defrauded by someone, we cannot undo it and we cannot recover it.

12. Limitation of liability

To the fullest extent the law allows, we are not liable for any loss of profit, revenue, opportunity, data or goodwill, or for any indirect, incidental, special, consequential or punitive loss, however it arises and whether or not we were warned it might.

To the fullest extent the law allows, our total aggregate liability to you for everything connected with this site and with $BANANA is limited to the greater of the amount you paid us directly — which for almost everyone is nothing — or one hundred United States dollars.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud or for death or personal injury caused by negligence. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

13. Indemnity

You agree to indemnify us against any claim, demand, loss, liability or expense, including reasonable legal fees, arising from your use of the site, from anything you post, from your breach of these terms, or from your breach of any law or third-party right.

14. Taxes

Any tax consequence of anything you do — acquiring, holding, disposing of or receiving anything — is yours to work out and yours to pay. We do not withhold, report, calculate or advise on tax, and we give you nothing you can rely on for that purpose.

15. Disputes

We do not designate a governing law or a forum in these terms. Which law applies to a dispute, and where it may be heard, is determined by the ordinary conflict-of-law rules of the place the question is asked. Nothing here is intended to take away a right you have under the mandatory consumer protection law of the country you live in, including any right to bring proceedings there.

Before anything else, raise it with us on X. Most things that look like disputes are misunderstandings about what this is, and section 2 usually settles them.

If any provision of these terms is held unenforceable, the rest continues in force and the unenforceable part is read as narrowly as necessary to make it valid.

In short: this is a game, $BANANA is a memecoin with no financial value, nobody is promising you will earn anything, you should expect to lose whatever you spend, and Fapes may never exist. If any of that is a problem, the right move is to close this tab. Back to the site.
